Terms of Service

By accessing or using Bimmerman ("Service," "Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Bimmerman. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

Bimmerman provides BMW-specific vehicle management tools, including:

• Service and maintenance tracking
• AI-powered chat assistant ("Ask Bimmerman")
• Mechanic quote analysis ("Smart Analyzer")
• AI-generated insights and recommendations
• Modification tracking and compatibility advice
• Cost tracking ("BMW Tax" Analytics)

The Service is provided "as is" and "as available." We do not guarantee uninterrupted access, error-free operation, or that the Service will meet your specific requirements.

3.1 Registration

You must create an account to use the Service. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account
• Be at least 18 years old

3.2 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Use the Service for illegal purposes
• Attempt to reverse-engineer or exploit the Service

4.1 Plans

• Free: Limited features, subject to usage caps
• Monthly: A$9/month, billed monthly, cancel anytime
• Annual: A$79/year, billed annually, cancel anytime
• Lifetime: A$199 one-time payment, access for life

4.2 Billing

- Payments are processed by Stripe. We do not store your full credit card details.
- Subscriptions auto-renew unless canceled before the renewal date.
- Price changes will be communicated at least 30 days in advance.
- You are responsible for applicable taxes (GST for Australian users).

4.3 Refunds

We offer a 30-day money-back guarantee for first-time subscribers. If you're not satisfied within your first 30 days, email support@bimmerman.com.au for a full refund.

After 30 days, refunds are at our discretion. Lifetime subscriptions are non-refundable after 30 days.

4.4 Cancellation

You can cancel your subscription anytime from your account settings. Access continues until the end of your billing period. No partial refunds for mid-cycle cancellations.

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate laws in your jurisdiction (including intellectual property laws)
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, crawl, or reverse-engineer the Service
• Use automated tools (bots) to access the Service without permission
• Abuse rate limits or engage in excessive API usage
• Resell, redistribute, or sublicense the Service
• Impersonate others or misrepresent your affiliation
• Harass, threaten, or harm other users

Violations may result in immediate account termination without refund.

6.1 AI Accuracy

Our AI features (Ask Bimmerman, Smart Analyzer, Insights) use large language models and machine learning. While we strive for accuracy:

• AI-generated content may contain errors or inaccuracies
• Recommendations are based on patterns and may not suit your specific situation
• Quote analysis is for informational purposes only, not professional appraisal
• We do not guarantee pricing accuracy or savings

6.3 No Warranty

We make no warranties about the accuracy, completeness, or reliability of AI-generated content. Use at your own risk.

7.1 Your Content

You retain ownership of content you upload (service invoices, photos, notes). By uploading, you grant us a license to:

• Store, process, and display your content to provide the Service
• Use uploaded documents for AI analysis (Smart Analyzer, Insights)
• Create anonymized, aggregated data for service improvement

7.2 Prohibited Content

Do not upload content that is illegal, infringing, defamatory, obscene, or harmful.

All content, features, and functionality of the Service (design, code, logos, trademarks) are owned by Bimmerman and protected by copyright, trademark, and other laws.

You may not:

• Copy, modify, or create derivative works
• Reverse-engineer or decompile the software
• Remove copyright or proprietary notices
• Use our trademarks without permission

BMW Trademark Notice

BMW is a registered trademark of BMW AG. Bimmerman is not affiliated with, endorsed by, or sponsored by BMW AG. All BMW-related data (model names, engine codes, specifications) is used for informational purposes under fair use.

Some jurisdictions do not allow limitation of liability for personal injury or incidental/consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Bimmerman and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or submit

11.1 Governing Law

These Terms are governed by the laws of the State of Victoria, Australia, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

11.3 Informal Resolution

Before filing any claim, you agree to contact us at support@bimmerman.com.au to attempt informal resolution. Most disputes can be resolved quickly and amicably.

The Service may contain links to third-party websites or services (forums, parts suppliers, mechanics). We are not responsible for:

• Content, accuracy, or availability of third-party sites
• Transactions or interactions with third parties
• Privacy practices of external sites (review their policies)

We reserve the right to:

• Modify, suspend, or discontinue any feature or the entire Service
• Change pricing with 30 days' notice (existing subscribers grandfathered for one billing cycle)
• Impose usage limits (API calls, storage, etc.)
• Update these Terms (we'll notify you of material changes)

If you disagree with changes, you may cancel your subscription. Continued use constitutes acceptance.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bimmerman regarding the Service, superseding any prior agreements.
